These legal Terms & Conditions outline the rules and guidelines governing the relationship between the agency and its clients, ensuring clarity, protection, and fair treatment for both parties.
1. General Terms

1.1. Agreement: These Terms & Conditions form a legally binding agreement between Tulevik Studio (referred to as “we,” “us,” “our,” or “the Studio”) and the Client (referred to as “you,” “your,” or “the Client”). By engaging our services, you agree to these terms.
1.2. Modification of Terms: Tulevik Studio reserves the right to modify these terms at any time. Any changes will be communicated to the Client and will take effect upon the date of posting.
1.3. Confidentiality: Both parties agree to maintain confidentiality regarding any proprietary or confidential information shared during the project.
1.4. Intellectual Property: All intellectual property created by Tulevik Studio during the project remains the property of the Studio until full payment is received. Upon payment, the Client will receive the rights to the final deliverables as specified in the project agreement.
2. Website Design Terms

2.1. Scope of Work: The scope of work for web design projects will be outlined in the project proposal and agreed upon by both parties before commencement.
2.2. Revisions: The project proposal includes a specified number of revisions. Additional revisions beyond this scope will incur extra charges.
2.3. Content: The Client is responsible for providing all text, images, and other content necessary for the website in a timely manner. Delays in providing content may affect project timelines.
2.4. Testing and Approval: The Studio will conduct testing to ensure the website functions correctly. The Client is responsible for final approval before the website goes live.
2.5. Third-Party Services: The Studio may use third-party services (e.g., hosting, plugins). The Studio is not responsible for any issues arising from these third-party services.
3. Branding Terms

3.1. Project Deliverables: Branding projects may include logos, color schemes, typography, and other visual elements as agreed upon in the project proposal.
3.2. Revisions: The proposal includes a specified number of revisions. Additional revisions will be subject to additional fees.
3.3. Usage Rights: Upon full payment, the Client will receive the rights to use the branding materials as outlined in the project proposal. The Studio retains the right to showcase the work in its portfolio.
3.4. Client Responsibilities: The Client must provide timely feedback and approval for each stage of the branding process to ensure the project stays on schedule.
4. Packaging Design Terms

4.1. Scope of Work: The scope of work for packaging design projects will be detailed in the project proposal and agreed upon by both parties.
4.2. Revisions: The project proposal includes a specified number of revisions. Additional revisions will incur extra charges.
4.3. Production: The Client is responsible for the final production of the packaging. The Studio will provide print-ready files as per the specifications agreed upon in the proposal.
4.4. Quality Assurance: The Studio will ensure that all design files are prepared to industry standards. The Client is responsible for proofing and approving all designs before production.
5. Consultancy Terms

5.1. Scope of Services: Consultancy services will be provided as outlined in the project proposal and agreed upon by both parties.
5.2. Deliverables: The deliverables for consultancy projects may include reports, recommendations, and strategic plans as specified in the proposal.
5.3. Revisions: The proposal includes a specified number of revisions or follow-up sessions. Additional revisions or sessions will be subject to additional fees.
5.4. Client Cooperation: The Client agrees to provide all necessary information and access required for the consultancy services to be effectively delivered.
6. Payment Terms

6.1. Payment Terms: Payment terms will be specified in the project proposal. Typically, a deposit is required to commence work, with the intermediatory payments according to defined milestones, and remaining balance due upon completion.
6.2. Late Payments: Late payments may incur interest charges as specified in the project proposal. The Studio reserves the right to suspend work until payments are brought up to date.
6.3. Refunds: Due to the nature of creative work, refunds are generally not provided. Exceptions may be made at the Studio’s discretion in case of termination before significant work has commenced.
6.4. Project Termination: Either party may terminate the project with written notice. The Client will be responsible for payment for all work completed up to the termination date.
6.5. Project Handover: Access to all project related content, files, data, creatives etc; will be handed over to client only upon full payment as per agreement. Tulevik Studio reserves the right to withhold all intellectual property till the final payment is cleared.

7.2. Dispute Resolution: Any disputes arising from these terms will be resolved through mediation or arbitration before pursuing any legal action.
